Уважаемые господа, Мы обращаемся к Вам от имени компании Apple Inc. (далее – “Apple”), корпорации штата Калифорния, с зарегистрированным адресом Уан Эппл Парк Уэй, Купертино, Калифорния 95014, Соединенные Штаты Америки. Apple является владельцем широкого перечня прав интеллектуальной собственности (далее – «Права ИС»), относящихся к всемирно известным технологическим продуктам и программному обеспечению компании, включая, среди прочего, знаменитый логотип Apple, товарные знаки “Apple”, “iPhone” и многие другие. Права ИС Apple включают также авторские права на официальные изображения продукции и элементы дизайна веб-сайта apple.com. Кроме того, Apple принадлежат Права ИС, охраняющие внешний вид, форму и конфигурацию продуктов компании. Указанные Права ИС охраняются по всему миру в соответствии с национальным и международным законодательством в сфере товарных знаков, патентов и авторских прав. Apple стало известно о нарушении Прав ИС компании на веб-сайте appleprostore.ru (далее – «Веб-сайт») путем: – использования охраняемых авторским правом официальных изображений продукции Apple;
– использования товарных знаков в доменном имени Веб-сайта (далее – «Домен»), осуществляемых без разрешения правообладателя или его уполномоченных представителей (далее совместно именуемые «Нарушения»).Магазин электроники — www.AppleProStore.ruУказанные Нарушения вызывают серьезную обеспокоенность у Apple, поскольку они способствуют формированию у потребителей ложного впечатления о наличии правовой или организационной связи между Веб-сайтом и Apple. Использование товарных знаков Apple в Домене также с высокой вероятностью может ввести потребителей в заблуждение относительно того, что Веб-сайт является авторизованным или иным образом связанным с правообладателем. Мы просим Вас обеспечить немедленное прекращение Нарушений владельцем Веб-сайта. В случае несоблюдения им указанного требования, мы просим Вас заблокировать Веб-сайт. Настоящим мы под страхом наказания за лжесвидетельствование подтверждаем, что: (1) Мы уполномочены действовать от имени Apple,
(2) Apple является владельцем Прав ИС,
(3) Указанные права были нарушены вышеописанными действиями. Настоящее письмо подтверждает факт Вашей осведомленности об обстоятельствах, свидетельствующих о фактах Нарушений. В связи с тем, что нарушающие материалы размещены на Ваших серверах (в рамках Вашей сети), мы требуем от Вас немедленного и окончательного прекращения Нарушений. Настоящее письмо является конфиденциальным сообщением, связанным с интеллектуальной собственностью Apple, и не подлежит публикации. Apple is the exclusive owner of a wide range of intellectual property rights (“IP Rights”) in connection with its hugely successful range of technology products and services including, without limitation, the famous Apple Logo, “Apple” and “iPhone” trademarks. Apple’s IP Rights also include copyright in its product images and other elements found on the apple.com website. Apple also owns many other IP Rights that protect the overall appearance, shape and configuration of its distinctive products. These IP Rights are protected around the world under various national and international trademark, patent, design and copyright laws. It has come to Apple’s attention that the website appleprostore.ru (the “Website”) is unlawfully violating Apple’s intellectual property rights by: – using proprietary images of Apple's products which are protected by copyright owned by Apple; and
– using Apple registered trademark(s) in the domain name for the Website (the “Domain”), all without the consent of Apple, or its authorized agents (collectively described as the “Infringing Activity”).Магазин электроники — www.AppleProStore.ruThis Infringing Activity is of great concern to Apple because it is likely to deceive consumers into believing that the Website is authorized or licensed by, or is otherwise affiliated with, Apple when it is not. In addition, the use of Apple’s marks in the Domain is likely to mislead consumers into thinking that the Website is authorized or licensed by, or is otherwise affiliated with, Apple. We request that you require the registrant to immediately cease its Infringing Activity. If the registrant fails to comply right away, we request that you disable the Website. By my signature below, I declare UNDER PENALTY OF PERJURY that: (1) We are authorized to act on behalf of Apple,
(2) Apple is the owner of the rights described herein, and
(3) These rights have been infringed in the above-referenced manner.
